Workplace-related claims of discrimination, sexual harassment, wrongful termination, and a multitude of other alleged offenses against employees and applicants continue to be filed, and the price for employer misconduct continues to grow.

In 2015, the U.S. Equal Employment Opportunity Commission (EEOC) received 89,385 charges of workplace discrimination and secured more than $525 million for victims of discrimination. In 2005, the EEOC received 75,428 of workplace discrimination.

Additionally, a survey on workplace trends undertaken by the Society for Human Resource Management found that nearly all of those polled believe that the growing complexity of legal compliance for employers will impact their organization. Roughly three quarters of those polled believe increases in discrimination litigation will also have an impact on their organization.

This course discusses the employment liabilities and laws that govern and affect the conduct between employer and employee.

PURPOSE
To provide an overview of employment-related laws and the liabilities that result from them.

LEARNING OBJECTIVES
After completing this course, the learner will be able to:

  • identify discrimination, and apply the appropriate federal and state anti-discrimination laws that protect individuals from discrimination;
  • recognize and categorize the two types of sexual harassment;
  • describe the circumstances in which claims of retaliation and wrongful termination often occur; and
  • differentiate between such workplace torts as assault and battery, defamation, fraudulent misrepresentation, invasion of privacy, negligent hiring, and wrongful reference.
